Prop 22 is a California law that protects the rights of gig economy drivers as independent contractors while providing them with extra benefits and protections when they are on the road. California gig drivers on Curri's platform are covered by Prop 22.
Here's what California gig drivers can expect with Prop 22:
Guaranteed Minimum Pay
Guaranteed minimum earnings equal to at least 120% of the local minimum hourly wage plus a $0.35 per-mile reimbursement for miles driven during active delivery time. Active delivery time is the total time spent performing the delivery, from when a driver begins their trip to when they deliver an order (but, it does not include time spent doing other things between pick up and drop off). Local minimum wage is based on the pickup location of the delivery. $0.35 per mile compensation is paid per mile driven to pickup and between pickup and drop-off during active delivery time.
When a driver's average compensation for the deliveries they completed during their pay period is less than the guaranteed minimum, Curri will make up the difference. A driver's pay period is a set 14-day period of time during which all deliveries must average out to be at least equal to the guaranteed minimum earnings.
For each pay period, Curri calculates and pays out guaranteed minimum earnings payments to drivers within two weeks of the end of the pay period.
Healthcare Plan Subsidies from Curri
California gig drivers may qualify for a quarterly healthcare subsidy, which is an additional payment from Curri to subsidize health insurance costs.
Only drivers that average at least 15 hours per week of active delivery time during a calendar quarter and are enrolled in a qualifying health plan will qualify for a health subsidy in that quarter. For each calendar quarter, Curri will notify all drivers that are eligible to receive a healthcare subsidy following the end of the quarter. Due to the nature of Curri's business, the volume of delivery opportunities available and the size of Curri's driver network, very few gig drivers have enough active delivery time to qualify for a healthcare subsidy in each quarter.
See Curri's help article on the Prop 22 Healthcare Subsidy for more information.
Occupational Accident Insurance Coverage
All Curri gig drivers in California are covered by an occupational accident insurance plan while performing deliveries on the Curri platform. The occupational accident insurance covers medical expenses and other losses a driver may experience due to personal injuries suffered while making deliveries on the Curri platform.
See Curri's help article on the Occupational Accident Coverage for more information.
Mandatory Rest Periods
All California gig drivers are required to take a break of at least 6 hours after being logged into our driver app for 12 hours or more within a 24 hour period. After at least a 6 hours break, drivers may resume delivery activities. All California gig drivers are expected to comply with these requirements.
Sexual Harassment Prevention Policy
Curri maintains and enforces a sexual harassment that applies to all users on the Curri platform. Prior to accessing the Curri Platform, all delivery service providers accept this policy as part of Section 5.2.6 of our Driver Agreement
See Curri's help article on the: Sexual Harassment Prevention Policy
Drug and Alcohol Zero Tolerance Policy for Drivers
Curri maintains and enforces a zero tolerance policy wi-h respect to any driver on the Curri platform being under the influence of drugs or alcohol while performing delivery services.
See Curri's help article on the: Zero Tolerance Policy for Drivers
Automobile Liability Insurance Coverage
Curri maintains automobile liability insurance with limits satisfying Prop 22's requirements, which covers injuries or other losses to third parties that are proximately caused by the operation of an automobile by a Curri gig driver during their active delivery time, in instances where the automobile is not otherwise covered by a policy that complies with state automobile insurance requirements.
